Guest and Couple Terms of Use
Effective 26 September 2026, version 2026-09-26
SpotMe is operated by HPK AI Labs, Ahmedabad, India.
These Terms of Use ("Terms") apply when you open an event gallery on SpotMe as a couple (through a Master Link) or as a guest (through a Guest Link). SpotMe is provided by HPK AI Labs, registered as a Micro, Small and Medium Enterprise (MSME) under the Udyam registration scheme, with its principal place of business at 22, Ellora Commercial Center, Relief Road, Ahmedabad, Gujarat 380001, India ("HPK AI Labs", "we", "us", "our").
By continuing past the notice on the login screen and verifying your mobile number, you agree to these Terms and our Privacy Policy. If you do not agree, do not continue.
These Terms are an electronic record under the Information Technology Act, 2000 and do not require a physical or digital signature. They are published in accordance with Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("IT Rules").
1. Who does what
- The photographer photographed the event, uploaded the photos, decided to use SpotMe's face recognition, and controls the event's links and settings. The photographer owns the copyright in the photos.
- HPK AI Labs runs SpotMe: we host the photos, run face recognition and deliver the gallery to you.
- A "couple" is anyone who logs in through the event's Master Link. A "guest" is anyone who logs in through the event's Guest Link.
2. Eligibility
2.1 You must be at least 18 years old to log in.
2.2 A parent or lawful guardian may log in and take a selfie of their child to find that child's photos. By doing so, you confirm that you are the child's parent or lawful guardian and that you agree to these Terms and the Privacy Policy on the child's behalf. Children must not log in or take a selfie themselves.
2.3 You need a valid Indian mobile number that you can receive SMS on. We send a one-time password (OTP) to verify it.
3. How SpotMe works
3.1 Couples can see all photos of the event, groups of photos by person ("people groups", each shown with a small face thumbnail), mark favourites, and choose photos to share with all guests ("highlights").
3.2 Guests take a selfie. SpotMe creates a face template from the selfie and compares it with the faces in the event's photos to find the photos you appear in. You will see those photos and the highlights the couple has shared with all guests. We do not store your selfie image: it is processed in memory and discarded. The face template is kept as described in our Face Data Notice.
3.3 Downloads are available only if the photographer has turned them on.
3.4 The photographer can turn the links off at any time. Events are archived automatically two months after the event is created, after which the links stop working. Download any photos you want to keep while the gallery is available.
4. Your consent to face matching (guests)
By continuing past the login notice and then taking a selfie, you consent to SpotMe creating a face template from your selfie and using it only to find your photos in this event. We never use it for any other event or any other photographer, never use it to train AI models, and never sell or share it for advertising.
If you do not want face matching, do not take a selfie. You can ask the couple or the photographer to send you your photos instead. You can withdraw your consent at any time by asking the photographer to delete your data for the event (your name, mobile number, face template and matches). You cannot delete it yourself in SpotMe.
5. Accuracy
Face matching is automated and may miss some of your photos or show you a photo of someone else, for example because of lighting, angle or similar-looking people. Faces that appear to belong to children under about 5 years old are not matched. If you are shown a photo that is not of you, do not download or share it, and let the photographer or us know. You can retake your selfie at any time.
6. Using the photos
6.1 The photographer owns the copyright in the photos. You may view and, where downloads are enabled, download the photos made available to you for your personal, non-commercial use, such as keeping them or sharing them with friends and family and on your personal social media.
6.2 You must not:
- remove or obscure any watermark or copyright notice;
- sell, license or use the photos commercially without the photographer's permission;
- use photos of other people to harass, shame, defame, impersonate or harm them, or to create altered or AI-generated images of them without their consent; or
- post photos showing other people where they have asked you not to.
6.3 Couples: the Master Link gives access to all photos of the event and the people groups. Do not post it publicly or share it with people you do not trust. Choose highlights with care, because highlights are shown to every guest who logs in.
7. What you must not do
You must not:
- use someone else's mobile number, or take a selfie of anyone other than yourself or your own child;
- impersonate anyone or give false information;
- share your OTP with anyone;
- try to access photos, people groups or data that are not made available to you, or bypass the Service's security or limits;
- scrape, copy in bulk or automate access to the Service;
- submit anything other than a genuine, live selfie, or submit malicious files; or
- use the Service in breach of our Acceptable Use Policy or any law.
We may block access or end your session if you breach these Terms.
8. Your data and removal requests
8.1 How we handle your personal data is explained in our Privacy Policy and Face Data Notice. The photographer who created the event can see your name, mobile number and activity in the gallery (for example, when you first visited, how many photos were matched and how many you downloaded).
8.2 Guests and couples cannot delete event data themselves. The photographer who created the event owns its photos and controls its data, so send any request to access, correct or delete your data, or photos of you, to the photographer. If you cannot reach the photographer, or they do not act within 15 days, email spotme@hpklabs.ai and we will follow it up. See our Data Deletion Instructions.
8.3 If a photo of you should be removed, contact the photographer or our Grievance Officer. If a photo exposes your private areas, shows you in full or partial nudity or in a sexual act, or is an impersonation (including an artificially morphed image), we will act to remove or disable access to it within 24 hours of receiving your complaint, as required by the IT Rules.
9. Service availability
SpotMe is free for couples and guests. We try to keep it available, but we do not guarantee that the gallery, face matching or downloads will always be available, accurate or error-free, or that photos will remain available for any particular time.
10. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Service is provided "as is" and "as available", and HPK AI Labs is not liable for any indirect, incidental, special or consequential loss. Our total liability to you arising out of or relating to these Terms or the Service will not exceed ₹1,000. Nothing in these Terms limits liability for fraud, or any liability or right that cannot be limited or excluded under applicable law.
11. Changes
We may update these Terms from time to time. The version and effective date at the top of this page show when they last changed.
12. Governing law and disputes
These Terms are governed by the laws of India, and the courts at Ahmedabad, Gujarat, India have exclusive jurisdiction, without limiting any right you have under a law that cannot be waived.
